I know this is not thread specific, but I could use a little help on this one. I recently was the high bidder on an online auction for a Yugo Mod. 24. The auction house phoned me and told me that this rifle didnt qualify as a C&R because it was manufactured in 1924. I looked through my C&R books and can't find a specific reference. I really dont want to go to a FFL dealer for transfer, when I think that this does qualify as a C&R. Any suggestions.

While many, many rifles aren't specifically listed in the ATF C&R listing, there is a paragraph near the beginning that indicates that any firearm not found on the excluded list, of 50 years old or older and in original configuration may be considered C&R.

Some dealers and individuals don't want to learn the rules, but I have found the passage and quoted it verbatim to dealers (with a section listing) in the past. sone have accepted it, others haven't budged - in which case I haven't purchased.

Sounds like they are thinking antique not C&R. We know as colectors its a C&R piece even though it may not be in the book. Maybe send an e-mail to BATF and ask for their input, forward there responce to the seller.

A Yugoslav model 1924 would have been manufactured from 1928-1945. I'm no expert but to the best of my knowledge these rifles are indeed C&R eligible.

BUT, You didn't check with the seller before hand and you cannot force them to ship to C&R so you may be forced to go through ffl or tell them to forget it.

I don't know if the laws vary from state to state but the booklet I received with my C&R states that any military
bolt action made prior to 1946 qualifies as long as it is still in it's original configuration. A couple of things mentioned that would pose a problem is if the receiver has been changed or altered or if a synthetic stock has been added. I
just received my C&R a couple of weeks ago.

The C&R list booklet (ATF Publication 5300.11) states that:

Page 2 - "To be recognized as a Curios or Relics, firearms must fall within one of the following categories:
1) Firearms which were manufactured at least 50 years prior to the current date, but not including replicas of such firearms;
2) Firearms which are certified by the curator of a municipal, State, or Federal museum which exhibits firearms to be curios or relics of museum interest; and
3) Any other firearms which derive a substantial part of their monetary value from the fact that they are novel, rare, bizarre, or because of their association with some historical figure, period, or event."

Section II Page 17 - "All Original military bolt action and semiautomatic rifles mfd. between 1899 and 1946."

Last week I FAXd a copy of Page 2 from the ATF's "Firearms Curio or Relics List" which describes what constitutes a Curio or Relic. I called the Auction house on Monday to see what actions had been taken. They told me that what I sent doesnt apply. I then told them to please cancel the transaction and refund my purchase price. On Tues. UPS showed up with my purchase. A prime example of the Right and Left hands failure to communicate.

The best part is that one of the ignorant guys there now has some explaining to do...

Ive had situations like this before. "Back in The Day" I ordered a Waffle Iron from the old Alden's sale catalog. My wife went to the PO, and lo and behold there from Alden's was a full carat diamond ring. Im not saying what the outcome of that mistake was. BUT, I will say this. Try to get a diamond off of a woman. I am now looking for a proper M24 stock assy though.
